Jeffrey Donovan was pulled over by a Miami police officer after allegedly swerving dangerously on the evening of July 12.
Burn Notice's sharp-dressed stand-out star failed a sobriety test performed at the scene. Police asked Donovan to submit to a breathalyzer test, which he refused, and he was then taken into custody on suspicion of DUI.
How did the police spot him? The Burn Notice actor (he plays the sexy and savvy former spy Michael Westen) admitted to swerving to avoid hitting the police officer who would arrest him moments later.
In words the man will soon come to regret, Donovan apparently told the cop, "Sorry, I didn't see the red light or your stopped car." Oops. The star followed it up with an equally unfortunate, "The only mistake I made tonight was drinking Benadryl with 3 glasses of wine," and "I really think I'm only borderline and not too drunk."
The super-hot cable show Burn Notice films in Miami, and is one of the USA Network's highest rated programs. In fact, the last episode brought the series back to number 1 status, according to Jeffrey Donovan's Twitter feed. (His tweets, incidentally, have not yet made any mention of the DUI.)
Apart from the hit TV series, Mr Donovan, 41, most recently worked on big screen opposite Angelina Jolie as the police officer who doubts Angie's character's story in Clint Eastwood's movie Changeling.
The star was released on his own recognizance after posting $1,000 bail.
Reports say that Donovan could face as much as six months in jail if convicted of the one count of DUI, but as a first-time offender, it's unlikely he will serve time.
Bottom line? If you have three drinks, you shouldn't be going anywhere.
